Terms of Service

1. Acceptance of Terms
By accessing or using Audientor (“the Service”), operated by TheAppMakerPro (“we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Audientor is a Data-as-a-Service (DAAS) platform that provides:
- Audience search and creation using data from People Data Labs (PDL)
- Anonymous website visitor identification via the SuperPixel
- Audience export to third-party marketing and advertising platforms
- AI-powered audience building using your own API keys (BYOK model)
3. Data Accuracy Disclaimer
Audientor does not guarantee the accuracy, completeness, or timeliness of any data. Audience data is sourced from People Data Labs and other third-party providers. Data quality depends on these upstream sources. Specifically:
- Contact information (email, phone, address) may be outdated or incorrect
- Estimated audience sizes are approximations, not guarantees
- Visitor identification match rates vary by traffic source and geography
- We do not verify email deliverability or phone number validity
You are responsible for validating data quality before using it in marketing campaigns.
4. Bring Your Own Key (BYOK)
Audientor uses a BYOK model for AI features and certain channel integrations. This means:
- You provide your own API keys from third-party providers (Anthropic, OpenAI, Google, etc.)
- You are responsible for all costs incurred by your API provider as a result of using the Service
- Audientor is not responsible for charges on your third-party accounts
- You must comply with each third-party provider's terms of service
- We store your API keys encrypted (AES-256-GCM) and use them only to execute actions you initiate
5. Channel Integrations
When you export audience data to third-party platforms (Facebook, Google Ads, Mailchimp, etc.):
- You authorize Audientor to transmit contact data to those platforms using your credentials
- You are responsible for complying with each platform's advertising policies and terms of service
- You must have a lawful basis for contacting the individuals in your exported audiences
- Audientor is not responsible for account suspensions or policy violations on third-party platforms
6. Email and CAN-SPAM Compliance
If you use Audientor to export contacts to email platforms or SMTP servers:
- You must comply with CAN-SPAM Act (US), CASL (Canada), GDPR (EU), and all applicable anti-spam laws
- You must include a valid physical address and unsubscribe mechanism in all commercial emails
- You must not send emails to individuals who have opted out of your communications
- Audientor provides the data — you are responsible for how you use it
7. SuperPixel and Visitor Tracking
If you install the Audientor SuperPixel on your website:
- You are the data controller for visitor data collected from your website
- You must disclose the use of tracking technology in your website's privacy policy
- You must comply with all applicable cookie consent and privacy laws in your jurisdiction
- You must provide visitors with an opt-out mechanism where required by law
- Audientor acts as a data processor on your behalf
8. Subscription and Billing
- Free accounts have no time limit but are subject to usage limits
- Paid plans are billed monthly via Stripe
- You may cancel at any time — cancellation takes effect at the end of the current billing period
- No refunds for partial months
- We reserve the right to change pricing with 30 days notice
- Failed payments may result in automatic downgrade to the free plan
9. White-Label Usage
If you use the white-label feature to resell the Service:
- You are responsible for your end clients' compliance with these Terms
- You must not misrepresent the source of the data (e.g., claiming you own the 280M+ profile database)
- You may brand the platform with your own logo, colors, and domain
- Audientor retains all intellectual property rights to the underlying platform
10. Limitation of Liability
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, consequential, or punitive damages
- Our total liability is limited to the amount you paid us in the 12 months preceding the claim
- We are not liable for data inaccuracies, third-party API failures, or channel integration errors
- We are not liable for costs incurred on your BYOK provider accounts
11. Acceptable Use
You may not use the Service to:
- Violate any law or regulation
- Send unsolicited bulk email (spam)
- Harass, stalk, or harm individuals
- Scrape or resell the raw data outside of the intended channel export functionality
- Attempt to reverse-engineer the platform
- Exceed your plan limits through automated means
12. Account Termination
We may suspend or terminate your account if you violate these Terms or engage in abusive behavior. Upon termination, your data will be deleted within 30 days. You may request immediate data deletion at any time.
13. Changes to Terms
We may update these Terms with 30 days notice via email or dashboard notification. Continued use after changes take effect constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration.
